A man whose wife died in the Omagh bombing is to launch an appeal after his claim for damages against the Chief Constable and Northern Ireland Secretary was struck out. Laurence Rush said he is determined to get justice 12 years after his wife Elizabeth was murdered in the Real IRA attack.
He had taken a civil action over alleged failures in the apprehension, detection and pre-emptive arrest of the bombers. Yesterday his claim was struck out by a High Court judge, who said in a ruling that the case "did not enjoy the potential prospect of success".
Mr Rush last night described the ruling as "a travesty" and said he would be launching an appeal to have the case heard. "It's a massive blow, it's a travesty," Mr Rush told the Belfast Telegraph.
"I am very, very disappointed for my wife and for my family, but I shall have my appeal. There is no way I will give up. "This is going to go right to the end, because I am determined to get justice."
Mrs Rush (57) was one of 29 people killed when the car bomb ripped through Market Street in the Co Tyrone town on August 15, 1998. She had been serving customers in her shop when the bomb exploded.
